01. Definition

  • Any plural shall include the singular and any singular shall include the plural and any gender shall include all genders.
  • Trading hours are defined by location and publicized at "Trading Locations".
  • Company shall mean IFE Group Limited, trading under "Chinabiz21".
  • Service shall mean any conveyance and/or services rendered to and/or arranged for the client in pursue of any contract conclusion and/or ancillary to any client order.
  • Agent shall mean any third party, including but not limited to any government department, business associate, contractor, etc., who becomes part in rendering services/goods offered by the company.
  • Client shall mean any person, legal entity or representative/part thereof who wishes to purchase any service/goods from Chinabiz21.
  • Documents shall mean any document provided by the client to the company, including but not limited to; electronically or physically delivered documents of various formats, images and letters, etc.
  • Insistence shall mean any request for Service and/or Goods supplied to the Client by the Company
  • T&C shall mean Terms and Conditions and referring to this T&C.

02. DISCLAIMER

The company reserves the right to amend, erase, include and/or announce new T&C at any time without prior notice. The current and last updated T&C shall prevail in any case.


In consideration of the service/goods purchased by the Client and payable to the Company, The Client accepts and agrees to the following terms and conditions

03. Client Acknowledgement and Liabilities

  • Any person who delivers Documents to and/or requests any Service/Goods from the Company, shall be authorised to sign any formal contract and/or application as the "Client".
  • Any person who delivers Documents to and/or requests any Service/Goods from the Company, on behalf of a Client, shall be authorised to sign any formalities on behalf of the Client as long as the person can produce an "authorization letter" on Client’s formal letter-head and need to sign a "statutory declaration".
  • The Client accepts full legal responsibility for the accuracy and truthful representation of any "authorization letter" and "statutory declaration" accompanying any Insistence.

04. Company Liability, Limitation and Exclusion

  • The Company shall not be liable and/or being made or held liable, nor assume responsibility for, but not limited to, any loss and/or damage arising out of any falsely provided and/or produced Document, late provision of any Document nor for any delay and/or rejection or completion of any Insistence.
  • The Company shall not be liable and/or being made or held liable, nor assume responsibility for, but not limited to, any loss and/or damage arising out of any incomplete and/or rejected Insistence due to circumstances or causes beyond the Company’s control.
  • The Company shall not be liable and/or being made or held liable, nor assume responsibility for, but not limited to, any injury, damage, loss, accident or delay to any person or property which may arise due to causes beyond the Company’s control and not occasioned by its fault nor due to any act of negligence of any other party, war, strike, civil turmoil, riots, fire, acts of any government agency thereof, failure of transportation communication, or acts of God.
  • The Company has used its best efforts in collecting, preparing and publishing data included within the Company’s website but disclaims to warrant that the information contained within its website is complete, accurate and/or legally representable and does not assume but therefore disclaims any liability to any person for any loss or damage caused by errors or omissions in the Company’s website, whether such errors or omissions result from negligence, accident or any other cause.
  • Save as otherwise provided herein, the Company shall under no circumstances whatsoever or howsoever arising be liable and/or being made or held liable, nor assume responsibility for, but not limited to, for direct or indirect or consequential loss or damage. Defenses and limits provided for in this contract shall apply in any action against the Company, but not limited to, for the loss, damage or delay whether the action founded in contract, tort, or otherwise.
  • The Company disclaims any liability for losses, damages, forfeiture’s of deposit or expenses, damages of any kind whatsoever incurred by the Client in the event of any Insistence applied for is denied or not obtained within a stated period of time due to circumstances beyond the Company’s powers, or through a Client default.

05. DELIVERY

  • The Company is authorised to self-deliver or contract a courier for the delivery of the Documents/Goods to the Client or his agent at the address nominated to the Company and it is expressly agreed that the Company shall be deemed to have delivered the Documents in accordance with this contract if it obtains a receipt or signed delivery docket for the Documents from any person at that address or through obtaining a courier delivery document from the courier company.
  • In the event of the client opting for a pick-up of the Documents/Goods at the Company premises, at time of handover of the Documents/Goods Clients shall confirm delivery by signing the delivery document furnished to the Client by the Company.
  • In any case, delivery of Documents/Goods shall only be deemed necessary due after full payment of the Insistence was confirmed by the Company.
  • Dates specified for completion of the Service and/or delivery of Documents/Goods are estimates only and the Company shall not be liable and/or held liable or deemed responsible for failure to complete the Service and/or deliver the Documents/Goods on such date or dates.

06. COMPLAINTS / REFUNDS

  • The Client’s right to compensation (if any) for any claim for loss or damage shall only be maintained, provided that the Client strictly adheres to the following:
  • Any right to damages or refund claim on Insistences against the Company which include paid-up Government fees or fees payable to an intermediary shall automatically be extinguished.
  • Any claim for damage to Documents must be lodged in writing to the Company within seven days of the date of change;
  • Any right to damages against the Company shall be extinguished unless action is brought within two months from the date of this contract or the date the Services/Goods were completed/delivered or Documents delivered, or the date the Services/Goods should have been completed or the Documents should have been delivered, whichever date occurs first.
  • In all cases where liability has not been excluded or limited by this contract or by mandatorily applicable statute, convention or law, the liability of the Company is limited to the lesser of HK$1000.00 or the value of the Documents the subject of the contract at the time the Documents were received by the Company, whichever is less.
  • In all cases, where liability cannot be excluded or limited by this contract, the liability of the Company for breach for any condition or warranty in relation to the Documents or the Services is limited to any one or more of the following as determined by the Company at its absolute discretion;
    • In the cases of Services/Goods:
    • the supply of Services/Goods again, or
    • the payment of a reasonable service fee costs on having the Services/Goods supplied again

      In the case of Documents:
    • the replacement of the Documents or supply of equivalent Documents, or
    • the payment of the reasonable costs of replacing the Documents or acquiring equivalent Documents

07. INSURANCE

  • The liability of the Company is defined and limited to any amount stated for specified loss and damage. The Company shall not be deemed to nor will it affect any insurance for any Insistence. It is up to the Client’s own determination and judgement to seek its own insurance cover for any purpose.

08. JURISDICTION

  • Any dispute arising under this contract shall be governed by the Laws of Hong Kong SAR

09. FORCE MAJEURE

  • In the event of the Company being unable to carry out any obligation under the contract due to any circumstance, matter or occurrence beyond its reasonable control (“force majeure”) the Company shall be excused from such obligations and any claims of loss and/or damage to the extent of such loss, damage, prevention, restriction or interference caused;
